The Nigerian Communications Commission (NCC) is contemplating the introduction of data regulation for the country’s telecommunications sector. The proposed regulation, currently in draft form, aims to establish a regulatory framework to protect and preserve data privacy within the Nigerian Communications Sector. Titled “Data Protection (Communications Services) Regulations, 2023,” the 25-page document outlines the NCC’s intent to enact this regulation based on the powers granted to it under section 70 of the Nigerian Communications Act, 2003, and other relevant powers.
According to the NCC, any licensee who fails to comply with the provisions outlined in the regulations will be subject to an administrative fine of N10,000,000.00. Furthermore, if the violation persists, the licensee will be liable for a daily default penalty of N1,000,000.00 until the infringement is rectified or discontinued. The regulations are divided into ten parts, covering various aspects of data protection and enforcement processes.
The NCC’s proposed data protection regulation underscores the importance of safeguarding data and ensuring privacy in the telecommunications sector.
