NERC Transfers Electricity Market Oversight to Abia State Regulator

The Nigerian Electricity Regulatory Commission (NERC) has formally transferred regulatory oversight of the electricity market in Abia State to the newly formed Abia State Electricity Regulatory Authority (ASERA).

The announcement was made on Wednesday through an official order shared on NERC’s social media platforms. According to the commission, the transfer is in compliance with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act (EA) 2023.

“In compliance with the amended Constitution and the Electricity Act 2023, the Nigerian Electricity Regulatory Commission has issued an order to transfer regulatory oversight of the electricity market in Abia State to the Abia State Electricity Regulatory Authority,” the statement read.

This development marks a significant shift under the new electricity law, which allows states to take control of intrastate electricity markets. Under the EA 2023, NERC remains the central regulator for interstate and international electricity activities, including generation, transmission, supply, trading, and system operations.

States wishing to regulate their own electricity sectors must officially notify NERC and request a transfer of authority, which Abia State has now successfully completed.

This transfer empowers Abia State to manage and regulate electricity generation, distribution, and supply within its territory, potentially paving the way for localized improvements in power delivery and infrastructure.
