The Nigerian Communications Commission (NCC) has issued a stern warning against the unauthorized use of the 5.4GHz frequency band. In a document signed by the Director of Public Affairs, Reuben Muoka, the NCC notified operators, private and public organizations, and the general public that the 5.4GHz frequency band, covering the range of 5.430 to 5.725GHz, is a licensed frequency in Nigeria.
According to the NCC, any transmission of signals or use of equipment on this band without obtaining a frequency license from the Commission is deemed illegal. Muoka emphasized that all telecommunications service providers, private or public organizations, or any individuals utilizing this frequency band across the country must adhere to the regulations set by the Commission.ict
In accordance with Section 122 of the Nigerian Communications Act (NCA), 2003, the NCC stated that operating in any frequency not duly assigned by the Commission is considered a criminal offense. The consequences for such unauthorized activities may include imprisonment, sanctions, and confiscation of equipment used in operating the illegal services.
To address the issue, the Commission has issued a 14-day enforcement notice to all unlicensed operators on the 5.4GHz frequency band, spanning 5.430 to 5.725GHz. The notice instructs these entities to immediately cease transmission of signals or the use of equipment on this band without proper authorization from the NCC.
The warning underscores the NCC’s commitment to maintaining regulatory control over frequency spectrums and ensuring compliance with established guidelines. This move aims to safeguard the integrity of the telecommunications landscape in Nigeria, prevent interference, and maintain the lawful use of allocated frequency bands. The NCC urges all concerned parties to comply with the enforcement notice to avoid legal consequences.
